Wirecard and EY: Deadline for filing in sample proceedings expires. Last chance to secure the claims of injured parties at a very low price. Those who do not act now are throwing away cash money!
On 18 September, the deadline expires for Wirecard victims to register their claims in the sample proceedings against EY. The specialised law firms handling these proceedings already have capacity problems and cannot take on new clients for much longer. Therefore, aggrieved parties should by no means wait until 18 September, but contact a suitable law firm immediately.
Despite all the weaknesses in the content of the model procedure, which have been criticised for a long time, it offers one advantage: at a very low price, injured parties can secure their claims against the statute of limitations. This is important, because the claims for damages against EY will become statute-barred at the end of 2023. Those who have not taken action by then will have lost their claims forever. This also applies to possible settlement solutions with EY: Should settlement talks with EY take place in 2024 or later, only those injured parties who have brought their claims to court in time will be considered. All others will go away empty-handed.
Dr Wolfgang Schirp from the law firm Schirp & Partner, Berlin, which represents over 70% of the claims pending against EY to date:
"Those who have not yet taken any action against EY should register their claims in the model proceedings now at the latest. Those who do not do so are throwing money away! If EY should offer settlement talks next year, which is not unlikely, only those injured parties who have secured their claims against the statute of limitations will be considered. All others will not be at the table. There is every reason to put in a bit of "play money" now to be there when solutions are negotiated. Those who don't will have to fret later."
